April 28 hearing of Pua’s application against Immigration order

The High Court will hear on April 28 an application for a judicial review by Petaling Jaya Utara MP Tony Pua to challenge an Immigration order barring him from leaving the country. Senior assistant registrar Nurul Aini Yahya set the date in chambers in the presence of Chua's lawyer, Joanne Chua, and senior federal counsel Natra Idris, representing the Immigration director-general and the government. Joanne told reporters the hearing would be before High Court (Appellate and Special Powers) judge Datuk Hanipah Farikullah. On October 1 last year, the High Court granted leave for Pua to file a judicial review to challenge an order by the Immigration barring him from leaving the country. Pua, who is also DAP's national publicity secretary, is seeking a declaration that the restriction order imposed on him on July 22, 2015, was unlawful and invalid. Besides seeking to quash the order, he is also asking for special damages, costs and other relief deemed fit by the court. The DAP leader said the order was ultra vires or beyond the authority of the respondents as he was not given any notice or opportunity to be heard prior to the decision. He added that the decision was unreasonable, unfair and mala fide or malicious against him.
